Case law
Supreme Court
SC rulings are mandatory guides for lower courts. Grand Chambers resolve chamber conflicts. Conclusions by dispute category — on the SC site and in the court registry.
Registry search
Technique: case category + keywords + court + date range. Search for SC phrasing ('legal conclusion', 'under such circumstances') — that's the precedential part.
How to use
In a claim/motion: cite case no., date, court, and quote the conclusion. Don't copy the case — show factual identity. Appeals and cassations look at practice per specific norm.
Divergent practice
Different conclusions on similar cases — reality. Defense: find the latest SC/GC position, show the opponent's factual distinction. ECHR — via art. 17 of the Enforcement Act.
ECHR
ECHR rulings are a source of law in Ukraine (art. 17). HUDOC — the ruling database, search by Convention article and state. Ukrainian rulings — especially weighty for national courts.
Monitoring
New practice — SC newsletter, bar publication reviews, cassation-instance Telegram channels. A practice change — grounds to revisit positions on the client's open cases.
