Tools, licenses and commercial use rules

Tools

  • Midjourney — Subscription

Strongest aesthetics; commercial use on paid plans

  • DALL-E 3 — Subscription/API

Built into ChatGPT; OpenAI allows commercial use

  • Stable Diffusion — Open

Free locally; license depends on model (SDXL — OpenRAIL)

  • Flux — Open/API

High text rendering quality; dev version is non-commercial

  • Adobe Firefly — Subscription

Trained on licensed content — business-safe

License rules

  • •Open-model images — check the specific model license
  • •Don't generate protected logos/characters — infringement risk
  • •For client work — paid plans with commercial rights
  • •AI generations lack copyright in most jurisdictions — add human authorship

License terms change fast — check Terms of Use before commercial projects. The US Copyright Office confirmed: pure AI generations are not protected, but human creative editing creates rights to the result. Ukrainian law is analogous — authorship belongs to humans.
