Property abroad

Buying property in Poland, Spain, Turkey: procedures, taxes, typical risks

Poland

Foreigners need Interior Ministry permission (city flats usually exempt, houses with land need it). 2% PCC resale / 8% VAT new build. Check the KW land register for encumbrances.

Spain

NIE number mandatory. ITP 6–10% resale (region-dependent), AJD ~1% on new builds. Nota simple registry check is essential. Community fees and annual IBI tax.

Turkey

Tapu is the title deed; foreigners can't buy in military zones and some regions. 4% tax on cadastral value (often understated). DASK earthquake insurance is mandatory.

Currency and payments

Pay via foreign bank or escrow: transfers from Ukraine need documented grounds (NBU limits). FX risk between booking and closing.

Remote purchase

Possible via POA to a local lawyer/notary. A Ukrainian POA needs consular or notarized form + apostille + translation.

Rent vs buy

For under 3–5 years renting is more flexible: purchase only pays back transaction costs over time. Buying makes sense for residency programmes (Spain, Turkey — limited).

Pre-deal checks

Encumbrances/mortgage in the registry, community/utility debts, technical condition, legality of remodels, seller history — a local lawyer checks all of it.

Deal price ≠ total cost: add purchase taxes (Poland ~2% PCC or 8/23% VAT on new builds, Spain 6–10% ITP, Turkey 4% tapu), notary, registration, annual property tax and service charges. Real markup — 8–15% on top.
