Insurance company dispute
Denied or delayed payout — a step-by-step defense plan.
Insurer denied — next steps
Demand a WRITTEN denial citing the contract clause/law. A verbal denial is worthless. Check whether your case truly falls under an exclusion and whether you missed document deadlines.
Pre-trial claim to insurer
Written claim to the insurer: event description, policy details, amount, contract references, response deadline (10–30 days). Send by registered mail or courier with stamp — it's court evidence.
Motor insurance: MTIB & guarantee fund
For motor TPL: complain to the MTIB about a member insurer; if the insurer is liquidated or the culprit uninsured — claim via the MTIB Central Guarantee Fund. MTIB review takes up to 30 days.
Complaint to the NBU
The National Bank regulates insurers: file an online complaint about delayed payment or unlawful denial. The NBU can't recover money but can fine the insurer — often enough pressure to pay.
Independent assessment
If the dispute is about loss amount — hire an independent assessor (for cars — your choice, not the insurer's). The report is key evidence; costs are recovered from the losing party in court.
Court
Civil suit: claim = insurance payout + Art. 625 CC interest (3%/yr + inflation for delay) + contractual penalty + expertise and court-fee costs. Courts usually account for the consumer's weaker position.
Common pitfalls
Missing the event-notification deadline (often 3–5 days — check your contract), signing an undervalued 'settlement agreement', lack of written confirmations. Keep all communications in writing.
