Legalizing replanning
Legalization procedure: project → works → new tech passport
1. What needs legalization
Removing/adding partitions, moving bathroom/kitchen, merging rooms, making wall openings — all replanning requiring a project. Cosmetic repairs and flooring replacement — no.
2. What's forbidden
Moving bathroom/kitchen above neighbors' living rooms, removing load-bearing walls, merging a gasified kitchen with a room, taking over common areas, expanding the bathroom at the kitchen's expense.
3. Step 1: project
A qualified design organization develops the replanning project from the BTI tech passport. Cost ~5–20k UAH depending on complexity.
4. Step 2: approval & works
Notice of works start to the architectural control body or project approval — depends on complexity category. Works by a licensed contractor.
5. Step 3: acceptance & new tech passport
Works acceptance act → new BTI tech passport with the new layout → registry updates. Until then the flat legally 'doesn't match documents'.
6. Unlegalized replanning
Consequences: fine, order to restore the layout, sale problems (buyer and bank see mismatch with tech passport), insurance payout denial.
Ukraine's regulatory state changes (building codes and control-body procedures) — check the current procedure at your administrative service center. The main rule: if room boundaries or engineering systems change — no works without a project, even if 'everyone does it'.
