Garden association docs

Status

A gardening association is a legal entity (co-op or NGO), registered with statute; general assembly is the top body. Without status, common land and utilities are legally in limbo.

Core documents

Statute (bodies, fees, exit), member registry, assembly minutes, annual budget, network handover acts (power, water, roads), payment ledger.

Fees

Entrance, annual (network upkeep), targeted (electrification, road). Amount — only by assembly vote. Debtors: written claim, then court — cutting power without a ruling is illegal.

Land

Plots — owned or leased by members, common land — on the association's balance. Common-land squatting is recoverable in court. Rights registered in the cadastre, not just the 'society book'.

Board

Chair and board — for a statute term (usually 2–3 yrs), re-elected by minutes. The chair signs contracts, runs the books. An audit committee — mandatory, yearly check.

Typical disputes

Fee misuse, cutting debtors off without a vote, board selling common land — all challenged via assembly or court. Minutes are the key evidence; keep them carefully.
