Water use rights

Water rights for fish farming: lease, special water use, permits

Types of water use

General water use is free, no permits (recreation, shore angling). Special water use is for business: water intake, discharge, using a water body for aquaculture. Fish farming in a pond/lake is always special water use requiring a permit (Water Code of Ukraine).

Leasing a water body

Most ponds/lakes are municipally owned: lease via the local council or a Prozorro.Sale auction. The water body lease contract is standard, up to 25+ years. The lease right is registered in the State Registry of Property Rights. Check first: the water body may already be leased, in a protection zone, or of national significance.

Special water use permit

Issued by the regional water resources office (State Water Agency). Application + technical justification + (for water bodies >10 ha) environmental impact assessment. ~30 days, fee — rent for special water use. The permit specifies intake/discharge limits and purposes (fish farming).

Fisheries documents

Separately: the fisheries exploitation regime for the water body (approved by the State Fisheries Agency) — defines stocking, harvest, closed seasons. Commercial harvest of wild stocks needs a special fishing permit. Growing market fish without harvesting wild stocks is simpler, but the regime is still agreed.

Common mistakes

Stocking fish before the lease and permit are done; leasing the 'bottom' without the water surface; ignoring the water protection zone (25 m for small rivers — construction limits apply); not renewing the permit after a change of business entity.

Water Code norms and regulations change — verify current versions and consult a water law specialist before filing.
