Emphyteusis, easements & other land rights

Forms of using another's land — how they differ and what registers

Land lease

The most common land-share use: contract up to 50 years, rent ≥3% of NGV, registered in the cadastre. Tenant's right is strong — document precisely.

Emphyteusis

Long-term inheritable right to use another's land for agriculture — up to 50 years, alienable. Rare but strong form of right.

Easement/servitude

Limited right to use another's plot: passage, utilities, water. Registered in the rights registry and transfers with the plot — check before buying.

Sublease

Transferring leased land to a third party — requires owner's consent unless the contract provides otherwise. A common dispute cause.

Claim right vs lease right

'Buying a lease' often means assignment of contract claims — check what registers: the lease right in the registry or just a contractual claim.

Superficies

Building right on another's land — the building is yours, the land isn't. Used for objects on leased plots.

All property rights to land register in the State Rights Registry (DRRP). A contract without registered right gives only obligation protection — a new owner may not recognize your rights.
